中国涉外民商事判例法制度之型构--兼谈《民法典(草案)》第九编

判例法是一种法律，判例只是提炼形成判例法的原材料。中国具有建立涉外民商事判例法制度的需求基础、哲学基础、历史基础和现实基础。涉外民商事判例法地位的确立应放置在我们现有的法律架构中，以成文法作为第一法源，判例法作为第二法源，使严格规则主义与法官自由裁量相结合。

中国内地与香港经济周期的区制状态及协同性分析

笔者运用Markov区制转移模型,对中国内地与香港经济周期的区制状态以及两地经济周期的协同性进行了检验.结果显示:一方面,中国内地与香港经济周期均存在显著的三区制性质,即经济周期可划分为"低速"、"适速"和"高速"增长区制;另一方面,中国内地与香港经济周期的协同性水平偏低,并且存在依赖于区制状态的"门限性质",即在不同的经济周期区制内呈现出不同的协同性水平.     

利用软解调序列的LDPC码闭集识别方法

为实现对包括低密度奇偶校验（LDPC）码在内的一系列“稀疏几何编码”的识别,基于软解调序列,设计和实现了一种闭集集合应用背景下的识别方法。以校验约束关系作为切入点,首先回顾了基于硬解调序列的传统识别策略;接着分析和推导了软解调序列所应满足的校验约束形式;通过引入后验校验对数似然比（CLLR）这一统计量,最终设计了相应识别算法。在事先给定先验编码集合的闭集应用模式下,仿真结果显示,算法明显占优,识别增益在低信噪比环境下可达2~6 dB。     

International bankruptcy and the spirit of comity: New U.S. law encourages cooperation among nations

While many international businesses are successful, others experience financial difficulties and file for bankruptcy. These cases pose challenges for bankruptcy courts worldwide because the assets of the debtor are located in more than one nation. How is this being handled? The trend is toward cooperation. Under the principle of comity, one nation gives effect to the laws and judicial decisions of another nation as a matter of deference and mutual respect. The Bankruptcy Abuse Prevention and Consumer Protection Act (the Act), effective October 2005, amends the bankruptcy code in several significant ways. One such amendment is Chapter 15: Ancillary and Other Cross-Border Cases. Chapter 15 not only embraces but also advances the spirit of comity.     

Implementing an Organizational Ethics Program in an Academic Environment: The Challenges and Opportunities for the Duquesne University Schools of Business

This paper acknowledges the paucity of attention regarding the development of ethics programs within an academic environment and describes in a case study how the Duquesne University schools of business attempted to introduce, integrate and promote its own ethics program. The paper traces the business school’s attention to mission statements, curriculum development, ethics policy, program oversight and outcome assessment. Lessons learned are offered as suggestions for others seeking to develop and implement an ethics program in their school.     

Evaluating Strategies for Negotiating Workers’ Rights in Transnational Corporations: The Effects of Codes of Conduct and Global Agreements on Workplace Democracy

Following the offshoring of production to developing countries by transnational corporations (TNCs), unions and non-governmental organisations (NGOs) have criticised working conditions at TNCs’ offshore factories. This has led to the emergence of two different approaches to operationalising TNC responsibilities for workers’ rights in developing countries: codes of conduct and global agreements. Despite the importance of this development, few studies have systematically compared the effects of these two different ways of dealing with workers’ rights. This article addresses this gap by analysing how codes of conduct and global agreements both independently and interactively affect workers’ rights. We do this based on a qualitative study of the Sri Lankan operations of a Swedish TNC in Sri?Lanka, and on interviews with union and NGO representatives actively involved in codes of conduct and global agreements. Our results indicate that global agreements independently address all the aspects included in codes of conduct, while also addressing additional, more process-oriented aspects of workers’ rights. Hence, on their own, global agreements seem to comprise the superior approach to promoting workers’ rights. Furthermore, our results indicate that promoting codes of conduct has negative interactive effects on global agreements. Based on these results, we argue that the current focus on codes of conduct is counterproductive for the promotion of workers’ rights.
